The appeal filed Wednesday follows last month's appellate court ruling, which upheld a lower court's decision to take control of the estate of Kathleen Savio away from Drew Peterson and give it to Savio's father and sister.
Peterson has denied any wrongdoing in the disappearance of Stacy Peterson, and he hasn't been named a suspect in Savio's 2004 death.
But after Stacy Peterson's 2007 disappearance, Savio's body was exhumed and her death was reclassified from accidental to a homicide.
Peterson's lawyer, Joel Brodsky, says he thinks the court will agree that the appellate court made errors in reaching its decision.

Drew's Lawyer: Cops Don't Believe Stepbrother
Police and prosecutors don't believe Thomas Morphey's explosive claims that he helped stepbrother Drew Peterson remove a mysterious blue barrel on the day Peterson's fourth wife vanished, defense attorney Joel Brodsky contended Tuesday.
If they did, Morphey already would have testified before the Will County grand jury, said Brodsky, who represents Drew Peterson.
"If they found him credible, [Morphey] would have been one of the first witnesses they would have brought in and they would have based the entire investigation and the entire case on his testimony," Brodsky said at a news conference called to rebut Morphey's first public allegations against his stepbrother.
Morphey, though, said the attacks on him by Brodsky and Drew Peterson indicate they are fearful about the information he has disclosed.
"From the very beginning, they have done nothing but paint me in a certain light," Morphey responded Tuesday. "If there was nothing to hide, why would they go to the extremes that they have?"
Brodsky flatly predicted that Morphey won't ever see the inside of a courtroom because prosecutors won't risk calling him as a witness.
